Terms of Service

1. Acceptance of Terms

By accessing or registering for EZWeb Platform ('Service') operated by MAF Excellent Co., Ltd. ('Company'), you ('User') agree to be bound by these Terms of Service in their entirety. If you do not agree to any provision, please discontinue use of the Service immediately.

2. Definitions

• 'Service' means the EZWeb Platform including the Website Builder, Dashboard, Portal, and all APIs provided by the Company.
• 'User' means any individual or entity that registers and uses the Service.
• 'Tenant' means the workspace for a business or organization within the platform.
• 'Content' means text, images, videos, and data uploaded or created by Users through the Service.

3. Registration and User Accounts

• Users must be at least 18 years of age, or have parental/guardian consent.
• Registration information must be truthful, accurate, and current.
• Users are responsible for maintaining the confidentiality of their password and for all activity under their account.
• The Company reserves the right to suspend or delete accounts that violate these Terms without prior notice.

4. Permitted Use and Prohibitions

• Do not use the Service for any unlawful, fraudulent, or harmful purpose.
• Do not upload content that infringes copyright, is obscene, or violates public morals.
• Do not attempt unauthorized access to the system or perform reverse engineering.
• Do not send spam or malicious content through the platform.
• Do not share, sell, or transfer account access rights to others without authorization.
• Do not use the Service in ways that impact system performance or security.

4.1 Acceptable Use Policy (AUP)

• Do not use the Service to create gambling websites, online casinos, sports betting, slots, baccarat, online lottery, or any form of gambling activity, which is illegal under the Thai Gambling Act B.E. 2478.
• Do not use the Service to sell, advertise, or promote illegal drugs or controlled substances.
• Do not use the Service to create phishing websites, scam pages, or impersonate other organizations.
• Do not use the Service to sell weapons, illegal goods, or counterfeit/pirated products.
• Do not use the Service to distribute child sexual abuse material (CSAM) or content related to the exploitation of minors.
• Do not use the Service to spread disinformation (Fake News) that may cause public panic or harm.
• Users who violate this policy will have their website suspended and account terminated immediately without prior notice. No refunds will be issued for prepaid services.
• Users agree to indemnify the Company for all damages arising from policy violations, including legal costs incurred by the Company.
• The Company may report illegal content to relevant law enforcement authorities in accordance with the Computer Crime Act B.E. 2550.

5. Subscriptions and Payments

• The Service is available in both free and paid tiers. Pricing details are shown on the Pricing page.
• Payments are processed via Stripe, a secure and industry-standard payment system.
• Fees are charged monthly or annually depending on the selected plan and renew automatically.
• Certain plans may include a free trial period as specified. No charges are incurred during the trial, but Users must provide credit/debit card information to activate the trial.
• At the end of the free trial, the selected plan will be charged automatically. Users may cancel before the trial ends at no cost.
• The Company reserves the right to adjust pricing with at least 30 days prior notice.

6. Intellectual Property

• Content created by Users through the Service remains the property of the User.
• Users grant the Company a non-exclusive license to use content to operate and improve the platform.
• EZWeb logos, branding, software, and platform components are the Company's intellectual property.
• Reproduction, modification, or use of Company intellectual property without written permission is prohibited.

7. Service Availability

The Company strives for continuous service availability but does not guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, with advance notice given when possible.

8. Limitation of Liability

• The Service is provided 'As-Is' without any express or implied warranties.
• The Company is not liable for indirect damages, special damages, or data loss.
• The Company's maximum liability is limited to fees paid by the User in the preceding 3 months.
• The Company is not responsible for content created or uploaded by Users on the platform.

9. Termination

• Users may cancel their account at any time through the Portal Settings page.
• The Company reserves the right to terminate service for users who violate these Terms without prior notice.
• After account cancellation, User data will be retained for 30 days before permanent deletion.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes shall be subject to the jurisdiction of the courts in Bangkok, Thailand.

11. Changes to Terms

The Company reserves the right to modify these Terms at any time. Users will be notified via email or in-platform notification. Continued use of the Service after modifications constitutes acceptance of the revised Terms.
